Fire Safety Compliance is Not Optional: Lessons from another Prosecution

A recent prosecution in Cambridgeshire has underlined just how serious the consequences can be for business owners who fail to comply with fire safety law.

A business owner in Wisbech, Fenland, was fined more than £4,700 after refusing to provide mandatory fire safety information requested under the Regulatory Reform (Fire Safety) Order 2005. Despite repeated opportunities to comply, the individual withheld key information needed for fire safety officers to carry out their inspection. This left officers unable to properly assess whether the premises had adequate measures in place to protect life.

After legal proceedings that began in 2024 and a subsequent appeal at Huntingdon Law Courts in July, the court upheld the prosecution, ruling the owner had breached fire safety law.

This case is a stark reminder that fire safety compliance is not a tick-box exercise. Under the Fire Safety Order 2005, all businesses must:

  • Provide information requested by fire authorities

  • Allow officers to carry out inspections

  • Ensure a suitable and sufficient fire risk assessment is in place

  • Take responsibility for protecting both staff and visitors

Failure to do so is a criminal offence, and as this case shows, the penalties can be both costly and reputationally damaging.

Why compliance matters

Fire safety legislation exists to save lives. Refusing to engage with fire authorities doesn’t just break the law, it places employees, customers, and the wider public in unnecessary danger.

By cooperating fully with inspections and keeping fire risk assessments up to date, business owners demonstrate responsibility and duty of care, while reducing the risk of devastating outcomes.

Lee Fielding, Senior Operations Manager at Legionella and Fire Safe Services, said:
“This case is a stark reminder that compliance is not just about avoiding hefty fines. Every business has a duty to make sure its buildings are safe for the people who use them. Fire safety laws are in place to save lives, and cutting corners or ignoring responsibilities puts both people and property at serious risk.”

DO I NEED A FIRE RISK ASSESSMENT?

Under The Regulatory Reform (Fire Safety) Order 2005, all landlords have a legal obligation to ensure that their residential or commercial property is safe from fire. Regular fire risk assessments are essential to achieving legal compliance in fire safety.
The introduction of this Order marked a significant transformation in fire safety regulations. Coming into force on 1st October 2006, it streamlined numerous existing local and national rules into a single, cohesive set of requirements. This consolidation aimed to simplify the management of fire safety and ensure clarity for those responsible.

Notably, the Order abolished the issuance of fire certificates, which had previously been a standard requirement. While these certificates are no longer valid, they can still offer valuable insights when developing a comprehensive fire risk assessment.

Responsibility under the new regulations extends to employers, owners, landlords, and occupiers of business or non-domestic premises. These individuals are designated as the responsible person and must ensure compliance with fire safety laws.

This shift highlights the emphasis on proactive fire risk management and accountability.Fire Safety Compliance Is Not Optional: Lessons From Another Prosecution
