New Home Office Survey Exposes Key Fire Safety Shortcomings Among Responsible Persons

New Home Office Survey Exposes Key Fire Safety Shortcomings Among Responsible PersonsNew Home Office Survey Exposes Key Fire Safety Shortcomings Among Responsible Persons

On September 30th, the Home Office released a survey outlining concerns over Responsible Persons’ (RPs) compliance with post-Grenfell fire safety laws, including the Fire Safety Act 2021, Fire Safety (England) Regulations 2022, and the Building Safety Act 2022. The survey emphasises the critical responsibilities of RPs, especially in high-rise and multi-occupied buildings.

Key Areas of Concern:

  1. Fire Risk Assessments (FRAs): Many RPs are not conducting FRAs regularly or using competent professionals, leading to inconsistent assessments. FRAs must now account for all fire safety features, especially in larger residential properties.
  2. Fire Door Maintenance: Fire doors are essential in preventing the spread of fire and smoke, yet the survey found that many RPs neglect regular inspections. Damaged or propped-open fire doors significantly increase risk, making regular maintenance essential.
  3. Lack of Resident Engagement: The survey highlights insufficient communication between RPs and residents regarding fire safety procedures, including the importance of fire doors, evacuation plans, and fire safety responsibilities. This lack of awareness can put lives at risk in emergencies.
  4. Awareness of Legal Changes: A concerning number of RPs remain unaware of the new legislative requirements introduced by the Fire Safety Act 2021 and the Building Safety Act 2022. These laws impose stricter duties on RPs, requiring better coordination with stakeholders and up-to-date safety records management.

Strengthening Compliance with the Law

The fire safety legislation places significant obligations on RPs. They must take proactive steps to ensure that fire risk assessments are comprehensive and updated regularly. Fire doors must be inspected, repaired, and maintained properly to remain fully functional in emergencies.

The survey further underscores the need for RPs to educate residents on fire safety protocols. Residents must understand the critical role of fire doors in preventing fire spread and the “do’s and don’ts” of using them—such as not propping them open or tampering with their mechanisms.

Additionally, RPs must ensure that their understanding of legal requirements is current. The Fire Safety Act 2021 and Building Safety Act 2022 have introduced stricter safety protocols, especially for high-rise buildings, where fire safety records must be meticulously maintained and shared with other relevant parties.

Fire Doors: Critical for Life Safety

The survey draws attention to a lack of awareness regarding the importance of fire doors. Properly installed and maintained fire doors are essential for containing fire and smoke, giving occupants time to evacuate safely. RPs should make residents aware of the following key points:

  • Do’s: Ensure fire doors are closed when not in use, report any damage immediately, and make sure they self-close correctly.
  • Don’ts: Never prop fire doors open or tamper with their mechanisms.

Moving Forward

The survey serves as a wake-up call to Responsible Persons to step up their efforts in fire safety compliance. With the Fire Safety Act 2021 and Building Safety Act 2022 placing new, stricter responsibilities on RPs, it is crucial that they ensure full compliance by conducting regular fire risk assessments, maintaining fire doors, and engaging residents effectively.

Managing Director Steve Morris said “The findings of this survey highlight the critical importance of Responsible Persons (RPs) staying ahead of fire safety legislation. As we’ve seen, compliance gaps in fire risk assessments and fire door maintenance can put lives at risk, especially in high-rise and multi-occupied buildings. It’s vital that RPs not only conduct regular assessments but also ensure residents are aware of the life-saving role fire doors play. At LFS, we’re committed to helping RPs meet these new standards through expert assessments and fire protection services.”
