Fire Safety Regs Ignored by Business Owner Given Custodial Sentence

Business owners, take heed: failure to comply with fire safety regulations can result in severe penalties, including a prison sentence. A recent case in Sheffield serves as a stark reminder of the dire consequences of neglecting fire safety.

Landlord Zahir Ahmed received a suspended jail sentence after admitting to multiple fire safety violations. This prosecution followed a harrowing fire incident in February 2022, which left 11 people trapped in a building’s stairwell.

The fire, which required the response of multiple fire crews, highlighted severe safety failures. Fire fighters, wearing breathing apparatus, located and stayed with the trapped individuals until the blaze was extinguished and the building ventilated. The rescue operations were further complicated when a firefighter fell through a collapsed staircase.

An investigation revealed shocking lapses: the building had no fire alarm, no emergency lighting, substandard fire doors, and inadequate staircase ventilation. These breaches put tenants at severe risk, leading Ahmed to plead guilty to six charges under the Regulatory Reform (Fire Safety) Order 2005.

On 6 June 2024, Sheffield Crown Court sentenced Ahmed to six months’ imprisonment for each offence (to run concurrently), suspended for 18 months. Additionally, he was ordered to pay £10,000 in prosecution costs and complete 250 hours of community service.

Judge Robinson, during sentencing, condemned Ahmed’s reckless disregard for safety, noting, “Mr Ahmed was wilfully not caring about the safety of individuals. There had been a dreadful fire, which resulted in a firefighter falling through the stairs. It could have been catastrophic and was, in my view, a near-fatal fire.”

Deputy Chief Fire Officer Andy Strelczenie emphasised the critical role of landlords and responsible persons in preventing fires and ensuring safety measures are in place. He warned, “This fire could have had a catastrophic outcome had it not been for the highly skilled professionalism of our firefighters. Due to the lack of fire safety systems and management within these premises, it was extremely fortunate in this instance that people did not die. This sentence reminds all responsible persons that we can and will prosecute people when they fail to adhere to the laws to keep people safe.”
